General terms and conditions of booking

Internal note: this text is a draft and must be reviewed by a lawyer before final publication. The English version is a translation and must be reviewed too. Fill in all the details in square brackets.

These general terms and conditions govern the booking of the trips and services offered by [COMPANY NAME] ([TAX ID/ICE]), with registered address at [FULL ADDRESS] and [AGENCY REGISTRATION/LICENCE], trading under the brand Un Viaje a Marruecos (hereinafter, the agency). By confirming a booking, the traveller declares that they have read and accepted them.

1. Prior information and trip proposal

Before booking, the agency sends the traveller a written proposal with the itinerary, the services included and not included, the accommodation category, the total price and the specific conditions. Prices published on the website are indicative and per person; the final price is the one shown in the accepted proposal.

2. Booking and deposit

A booking is confirmed when the traveller accepts the proposal and the agency receives the deposit. Once it is received, the agency sends the booking confirmation.

The deposit is 15% of the total price of the trip. It is paid when booking and deducted from the total price.

Services are not guaranteed until the agency receives the deposit, and their availability may change in the meantime.

3. Payment of the balance

The balance is paid on the first day of the trip, unless the proposal says otherwise, in cash or by bank transfer. It can also be paid by PayPal or card, with a 5% surcharge on the amount paid that way. Bank or currency conversion fees charged by the traveller's bank are the traveller's responsibility.

4. Prices

Prices are in euros (€) and include only the services detailed in the proposal. Unless stated otherwise, they do not include international flights, insurance, drinks, meals not specified, optional monument entry fees, tips or personal expenses.

5. Cancellation by the traveller

The traveller may cancel their trip at any time by notifying [EMAIL] in writing. The date and time the notice is received determine the conditions that apply.

  • Private tours and day trips: cancellation is free up to 48 hours before the start of the trip, and the full deposit is refunded.
  • Group tours (shared departures, including the "Small group" option of the desert tours): cancellation is free up to 10 days before the departure date, and the full deposit is refunded.
  • If the cancellation arrives after those deadlines, or the traveller does not show up, the deposit is not refunded.

Any amounts due will be refunded within 14 days using the same payment method.

6. Changes requested by the traveller

The traveller may request changes to dates, itinerary, accommodation or number of people. The agency will try to accommodate them subject to availability, and will report any price difference or amendment charge before applying them. Date changes requested at short notice may be treated as a cancellation followed by a new booking.

7. Changes or cancellation by the agency

For reasons beyond its control (weather, road conditions, decisions by the authorities, closure of monuments or other causes of force majeure), the agency may be obliged to change the order of the itinerary, an accommodation or an activity. In that case it will offer an alternative of equivalent or higher quality. If the agency cancels the trip for reasons attributable to it, it will refund the amounts paid in full. On group tours, the agency may cancel the departure if the stated minimum number of travellers is not reached, giving [X] days' notice and refunding the amount paid or offering an alternative.

8. Traveller documentation

Each traveller is responsible for carrying a valid passport and, where applicable, the visa or entry authorisation required for their nationality, and for meeting the health requirements in force. The agency provides guidance, but recommends always checking the requirements with official sources before travelling. The agency is not liable for the consequences of failing to present the correct documentation.

9. Travel insurance

The agency strongly recommends taking out travel insurance that covers medical assistance, repatriation, luggage and cancellation costs, and that includes the planned activities (camel rides, quad or buggy rides, balloon flights, hiking). Unless expressly stated, the trip price does not include any insurance.

10. Liability

The agency is responsible for the proper organisation of the services contracted and acts with due diligence in selecting its suppliers. It will not be liable for damage arising from force majeure, from acts of the traveller or of third parties unconnected with the provision of the services, or from services contracted by the traveller directly with other suppliers.

Some activities, such as camel rides, quad, buggy or 4x4 trips and balloon flights, are provided by specialist companies and carry their own risks. The traveller must always follow the safety instructions of the people running the activity and report any relevant health condition beforehand.

11. Conduct during the trip

The traveller undertakes to respect local laws and customs, the other participants and the agency's partners. The agency may exclude from the trip anyone who puts the safety or the smooth running of the group at risk, with no right to a refund for services not used.

12. Complaints

If any problem arises during the trip, the traveller must report it immediately to the guide, the driver or the agency on +212 611 24 38 01, so that it can be resolved at the time. Later complaints must be sent in writing to [EMAIL] within [30] days of the end of the trip, with supporting documentation attached. The agency will reply as soon as possible.

13. Data protection

Travellers' personal data is processed in accordance with our Privacy policy.

14. Applicable law and jurisdiction

These terms are governed by the laws of the Kingdom of Morocco. For any dispute, the parties submit to the courts of [CITY], without prejudice to the rights that consumer protection legislation may grant the traveller in their country of residence.
